Our SCOTUS Prediction: Edith Jones
“I am hopeful that with the debacles of the twentieth century, we can recover the original intentions of the framers of the Constitution.”
– Judge Edith Jones
According to Wikipedia: Edith Hollan Jones (born in Philadelphia, Pennsylvania, 1949) is a judge on the United States Court of Appeals for the Fifth Circuit.
Her credentials:
- Jones graduated from Cornell University in 1971. She received her J.D. from the University of Texas School of Law in 1974. She was in private practice in Houston, Texas from 1974 until 1985, working for the firm of Andrews, Kurth, Campbell & Jones, where she became the firm’s first female partner. She specialized in bankruptcy law. She also served as General Counsel for the Republican Party of Texas from 1982-83.
- She was nominated to the Fifth Circuit by President Ronald Reagan on February 27, 1985, and confirmed by the United States Senate on April 3, 1985. She received her commission on April 4, 1985, at the age of 36.
- She sits on the board of directors of the Boy Scouts of America, the Garland Walker American Inns of Court, and is a member of several American Bar Association committees.
She went to Cornell, she worked in Texas, she was nominated by Reagan, and she’s a strong family-values woman — married with three children. What else could Ann Coulter we ask for?

PoliPundit observes, “Liberals are trembling again!”

Mark Noonan asks, “So, you want to have a battle?”
(Because the left is ready for a fight)
RenewAmerica suggests:
“Potential Democratic supporters include Sen. Mary Landrieu of Louisiana (up for re-election in three years, and from a state in Judge Jones’ circuit–it would be tough for her to vote against a Southern woman); Sen. Bill Nelson of Florida (up for re-election next year); Sen. Blanche Lambert Lincoln and Sen. Mark Pryor of Arkansas (a state neighboring Louisiana, which now has a competitive GOP organization); and Sen. Ben Nelson of Nebraska (one of the nation’s two or three most pro-life states).”
In September, Wes Vernon wrote:
“At 56, Judge Edith Jones would be an ideal pick to replace Sandra Day O’Connor. Her selection would advance the (not always successful) effort on the part of Republican presidents to appoint justices who read the law and the Constitution for their meaning as written and with a full appreciation for the fact that the Supreme Court was never intended to be a super-legislature. She would fit right in with Justices Antonin Scalia, Clarence Thomas, and (hopefully) Chief Justice-to be John Roberts.
The left-wing will scream and smear if this good woman is nominated. That will only reinforce support among those who voted for President Bush last year in part because they approved of him for the enemies he had made, and because they wanted conservatives on the Supreme Court. This president has not backed down from a good fight on principle. And Judge Jones has shown she is of stern stuff and can withstand the verbal brickbats.
Let them holler, Mr. President. Follow your instincts. Do what has to be done.”
Solid advice. And we hope W. gets back his cowboy swagger. Lord knows, he’ll need it.

Jones? Not a chance.
She heard McCorvey v. Hill, the attempt to reopen Roe v Wade
http://www.ca5.uscourts.gov/opinions/pub/03/03-10711-CV0.wpd.pdf
In her powerful 5 page separate opinion, she wrote -
“Hard and social science will of course progress even though the Supreme Court averts its eyes…. One may fervently hope that the Court will someday acknowledge such developments and reevaluate Roe…accordingly. That the Court’s constitutional decisionmaking leaves our nation in a position of willful blindness to evolving knowledge should trouble any dispassionate observer not only about the abortion decisions, but about a number of other areas in which the Court unhesitatingly steps into the realm of social policy under the guise of constitutional adjudication. ”
She will be filibustered. Republicans will go along with it. The is not the slightest chance that McCain, Snow, Chafee, Collins, Snow, Graham, Warner or Specter would vote to change the rule to bring her to a vote, and no chance that any Democrat would do so. The temporary split we have int the party right now would be permanant.
For that reason, Bush (despite his misstep with Miers) won’t nominate her. He has to find a brilliant conservative that hasn’t taken a public stand on Roe. Maybe Chris Cox.
