First Amendment Under Attack, Part II

Earlier today, I wrote that the FEC is hinting that regulating the political blogosphere might soon happen. After giving it more thought, I’ve modified my position ever-so-slightly.
First things first: I’m still deathly opposed to any restrictions on my First Amendment rights as a blogger. There’s nothing positive about the government’s watchdog agency for politics regulating what or how much I can say as a blogger. PERIOD!!!

Secondly, I still strongly recommend all bloggers and blog readers to pick up their phones and call their representatives in the House and Senate and tell them that voting for the Online Freedom of Speech Act is a hot button item with you and that they’d better get this right and vote to pass it. ASAP. Anything less is totally unacceptable. (To those of you who have representatives serving on the House Rules Committee, I strongly urge you to get them on the phone and tell them they’d better pass the rule so that the bill will be debated ASAP.)

Ultimately, though, this is in the legislators’ and regulators’ hands. If the do-gooders at the FEC decide that they’re going to start regulating political content on the blogosphere, then I’d suggest that we challenge the ruling in court up to and including the U.S. Supreme Court. Ultimately, I believe that the Roberts Court would overturn whatever restrictions the FEC tries imposing on us as well as large sections of McCain-Feingold, which is long overdue.

Let me be clear, though, about this: Taking legal action is the last option, an option that I’d rather not rely on. The first, and I believe best, option is pressuring our legislators that their political careers are on the line if they don’t pass the Online Freedom of Speech Act. It’s amazing how politicians react when they get deluged with mail, emails and phone calls from their constituents of all political persuasions to pass this bill.

In conclusion, I urge everyone reading this post to ramp up the intensity and pressure on Congress starting Friday morning. We’d better because our liberties are under fire.
