Today’s top story: President Bush has nominated Judge Samuel Alito for the Supreme Court.
SCOTUSBlog offers this brief biography:
Judge Alito currently serves on the U.S. Court of Appeals for the Third Circuit. Prior to his nomination to the Third Circuit by President George H.W. Bush, he served as U.S. Attorney for the District of New Jersey (1987-1990), Deputy Assistant Attorney General (1985-1987), and Assistant to the Solicitor General (1981-1985).Judge Alito was born in 1950 in Trenton NJ. He attended Princeton University and Yale Law School. He clerked for Judge Leonard I. Garth on the Third Circuit.
According to Law.com, Judge Alito is a man called “The Mild-Mannered Scalia.” He represents conservative principles that we can all gather behind.
“Personality-wise, on the bench and in person, Alito is no Scalia.Though he’s a frequent dissenter and not at all afraid to disagree with his colleagues, Alito’s opinions are usually devoid of passion. And his tone during oral arguments is probing but always polite.
. . .On the hot-button issues, Alito has been consistently conservative.”
In the days, weeks and months ahead, there will be much written about this nomination. A battle is surely afoot.

Ok, our prediction didn’t come to pass. But we’re very happy with Judge Alito and strongly support President Bush on the nomination.
ABCNews reports:
“Judge Alito is one of the most accomplished and respected judges in America,” the president said in announcing Alito’s selection. “He’s got a mastery of the law and a deep commitment to justice.” Bush exhorted the Senate to confirm his choice by the end of the year.

Patterico analyzes Alito’s dissent in Planned Parenthood v. Casey:
In that case, Judge Alito wrote a cogent dissent which argued for the validity of a law requiring spousal notification before an abortion.
We need to be ready to counter this talking point if Judge Alito is nominated. Luckily, we are armed with the truth.

Had they pledged to support her, Bush likely would have allowed her to coast through the hearings to a floor vote despite the dissatisfaction on the right.”

Ron Fournier, the AP’s political writer is reporting: “President Bush will nominate Samuel Alito to the Supreme Court, rebounding from a stinging rebuke over his first choice by tapping a conservative federal judge to replace retiring Justice Sandra Day O’Connor, a moderate. Bush plans to announce the nomination at 8 a.m. EST, two senior Republican officials said Monday.”
Fournier further reports that:
Judicial conservatives praise Alito’s 15 years on the Philadelphia-based court, a tenure that gives him more appellate experience than almost any previous Supreme Court nominee. They say his record shows a commitment to a strict interpretation of the Constitution, ensuring that the separation of powers and checks and balances are respected and enforced. They also contend that Alito has been a powerful voice for the First Amendment’s guarantees of free speech and the free exercise of religion.
Liberal groups, on the other hand, note Alito’s moniker and say his nomination raises troubling concerns, especially when it comes to his record on civil rights and reproductive rights. Alito is a frequent dissenter on the 3rd Circuit, one of the most liberal federal appellate benches in the nation. In the early 1990s, Alito was the lone dissenter in Planned Parenthood v. Casey, a case in which the 3rd Circuit struck down a Pennsylvania law that included a provision requiring women seeking abortions to notify their spouses.
Apparently this is a great nomination because “liberal groups”, presumably PFAW, NARAL and NOW, are opposed to him. It also sounds like soon-to-be-Justice Alito will be a strong advocate against abominations like McCain-Feingold and the dual Supreme Court rulings banning the display of the Ten Commandments and allowing the display of the Ten Commandments. Good enough for me.

I’m sick of always saying “my Muslim contact,” so from now on I will refer to him as “Alex.†It’s vague enough to keep him protected from the wrath of Islam, and given what he continues to tell the non-Muslim world about Islam’s intentions, he needs protecting.
Alex doesn’t live in America. His observations come from a childhood raised in Islam, carefully studying us from a distant vantage point and applying a genius-level IQ to define what he sees; and what he sees is a nation on the brink, and an enemy ready to shove.
Over the past few months, we have had the opportunity to discuss many topics affecting America and the world in general. Why the urgency from a man who isn’t even American? Because as Alex puts it, “America has to remain the dominant power in the world; otherwise it will be run by Islam and Communism, and freedom will only be a memory.†His analysis of what is so right about Americaâ€â€its passionate defense of world freedomâ€â€was right on the nose. As you will see, his caveats for America and the world are too.
AMERICA’S BORDERS: America is being diluted by people who are lazy and dumbing her down. They aren’t coming to you with anything to add, only everything to take. You have absolutely no control over who enters and who doesn’t, so you can’t tell if someone will be an asset or a liability to you. You say illegal immigration is against the law, but you keep giving amnesty to these criminals and do nothing to secure your borders. Recent events have made it undeniably clear that there are people out there who will stop at nothing to destroy you, yet you seem to apologize for defending yourself. You spend billions each year on printing government documents in both Spanish and English, in spite of having voted yourself an English speaking nation. No one else does that; why do you? Since when does the minority of the people call all of the shots? What happened to majority rule? There are already schools in southwest America that teach all subjects in Spanish. The number one need within any nation is the ability to communicate. You are shooting yourself in the foot. You need to close your borders, seal them off, capture all illegals, put them in prison, and then use them as labor for all of those so-called jobs that no one else will do. This would not only slow the invasion, but be a boon to your economy. The government should be doing what the Minutemen are doing, but if you the people are the “real Government†as you say, then you need to take it over. The recent Minutemen success has proven that you can do this, and do it well. Your government has failed you, and your constitution provides for you to take it back in such an instance. If now isn’t such an instance, then there never will be one. Other lands might wail and gnash their teeth, but you’ll be safer and healthier. Stop apologizing for thinking of yourself.
YOUR MEDIA: I don’t understand this area of America at all. They seem intent on anything and everything that belittles and destroys the foundations of your country. They never support your wars or your soldiersâ€â€at least not since Vietnamâ€â€and deliberately only cover stories that will turn the world against you and get your men killed. I come from a land in the Middle East where there is absolutely no freedom of the press, and I love America’s fearlessness in supporting a free press. But the balance isn’t there. They are so horribly skewed in favor of communism and even in favor of your Islamic enemy that they don’t even try to hide it. They are the ones who gave words such as “racist†and “sexist†too much power, and they throw them around like kids pitching balls. And you Americans seem to feel so guilty for said “racism†that you let them! It isn’t racist to call people who would kill you your enemy, nor is it racist to want to keep criminals out of your home. We often watch your news from (the nation where Alex now lives) and look at one another in amazement at the way your press seems to take pleasure in obliterating you. Why won’t you do something about this? They’re not the only ones with freedoms.

AP reports: “Two American soldiers have been charged with allegedly assaulting two detainees at a U.S.-led coalition base in southern Afghanistan, the military said Sunday.”
Sounds serious. What now?
“The two troops allegedly punched the detainees on the chest, shoulders and stomach while they were being held at a base in Uruzgan province, a statement said. Neither detainee required medical attention, it said.”
Military detainees. Punched, but not in the face. No medical attention required. And this makes a national news headline?
Call it neutering our armed forces. Better reporting would explore why our soldiers used a little physical force against the detainees. Maybe they were being hostile?
But the MSM would never give our military the benefit of the doubt.

AP reports: “Italian Premier Silvio Berlusconi, one of President Bush’s strongest supporters over Iraq, says he tried repeatedly to dissuade the American leader from going to war and was never convinced military force was the best way to bring democracy.”
Berlusconi did not elaborate on what other options could have been advanced. Now, we hear the words of a man who’d rather grovel to stay in office than stand strong and say, “Molto buon. We did the right thing”
“I was never convinced that war was the best system to bring democracy to the country and to get rid of a bloody dictatorship,” Berlusconi said of Saddam Hussein’s Iraq. “I tried several times to convince the American president to not go to war.”
“I believed that military action should have been avoided,” he was quoted as saying.
Instead, a mighty coalition consisting of Jacques Chirac, Gerhardt Schroeder, George Galloway, Cindy Sheehan, Michael Moore, Sean Penn and Martin Sheen, all led by the U.N.’s Kofi Annan, would’ve written some very forceful correspondence using the strongest language known to diplomacy — maybe even produced an accompanying music video — demanding Saddam to step down, stop supporting terrorism, stop killing, torturing and raping his people, and — we really, really mean it (don’t make us issue another resolution) — to introduce feedom and liberty into the region.
That woulda worked. Duh. What were we thinking?

Mayor Sam’s got it right — the Los Angeles Unified School District (LAUSD) has been sucking taxpayers dry for decades and now wants another $4 billion to crank out more illiterate dropouts. I have two short stories about what many Angelenos now call LA’s mummified school system:
Jan (not her real name) was a flower child of the 60s: a daisy-waving-psychedelic-peacenik-free-love-liberal-Democrat-bimbo who bore a love child after high school. Jan spoiled her baby with no discipline or boundaries. One day when her toddler misbehaved and I offered a suggestion, Jan told me to mind my own business. Unfortunately for her child, I did.
About ten years later when the girl turned 13, Jan called and sounded hysterical: “Clark, I don’t know what to do. I have to go to work. She took my keys, my car and my wallet and left with her boyfriend. I think she’s on drugs or something. What should I do?â€Â
It was too late. A few years later when her child returned to prison, Jan got custody of all five of her daughter’s children. That lasted a few months – until DPSS finally declared Jan an unfit mother and took them away.
Why is this relevant?
Jan is not only my cousin (yup, a blood relative), but has taught LAUSD elementary school children for about twenty years.
Although she is unfit to raise her own children and grandchildren, the United Teachers of Los Angeles protects her job at the expense of her classroom children. Jan doesn’t want you to vote for Propositions 73 through 78.
My second story is shorter: I used to jog to-and-from work at LAPD’s West Valley Station. One day as I jogged past Mulholland Junior High School, I noticed a male student leave the school grounds as classes began. I watched the 9th grader run across the field and hop the 12-foot fence. He landed near me. When I told him to get back in school - he told me to “F— myself.” I grabbed his wrist and walked him to the school office.
When I delivered the boy to the Principal, she demanded to know what right I had to kidnap the child from the street. When I identified myself as an LAPD officer and explained the relationship between school truancy and daytime residential burglaries, she made a complaint against me with the LAPD!
Based upon these and many other on-duty experiences with the LAUSD, I moved to Ventura County where my children would be far from LAUSD and their dysfunctional teachers and administrators.
That school principal doesn’t want you to vote for Propositions 73 through 78 or school vouchers for inner city families, however she does want more of your money.
The LAUSD is as competent as an unfit mother who spoils her children without teaching discipline. The only LAUSD program I would endorse is disbandment. The unions are too strong and too dangerous for our children. If LAUSD was dissolved tomorrow, competent educators would find better jobs at better schools, leaving dangerous and incompetent teachers to find careers far from where they can influence our children.

Over the past few weeks, I’ve written about Laurence Wilkerson’s diatribes portraying a “cabal” that “hijacked foreign policy” headed by the Vice President. Now we’re being told that Scooter Libby will be indicted by Patrick Fitzgerald for not remembering a conversation he had with Judith Miller. The only reason he’s being indicted is because the CIA is waging war against the Bush administration.
This war started when Dick Cheney was Defense Secretary and the CIA was giving General Schwarzkopf bad information on structure damage. The war resumed when the CIA botched things pretty badly with 9/11. The CIA got uppity when the President decided to wage war on Iraq. At one point, after Saddam was captured, the CIA reported in the NIE that the best we could hope for was that they’d just devolve into civil war and that at worst, the ‘insurgency’ would be the greatest terrorist recruiting tool in ages.
The CIA got politically active again a little over 2 years ago when they sent Joe Wilson to Niger at the suggestion of his now-famous wife Valerie Plame. When reporter Robert Novak used her name in a column, the CIA sent the Justice Department a referral to look into leaking her name. What’s curious about that is that referrals are supposed to be confidential. How did the public outcry happen if the referral was kept confidential? Who let reporters know that the CIA had refered a case to the Justice Department? The CIA leaked that referral, that’s who. To believe otherwise is to say that the Bush administration’s Justice Department leaked it.
Simply put, that didn’t happen. The Bush administration lets out information with an undersized eyedropper. They certainly didn’t leak information that could potentially hurt them.
My questions are: When will we see an investigation into the CIA’s political tactics? When will Porter Goss get these tyrants thrown out of the CIA?

The LA Times reports:
In the first program of its kind in the country, high-risk sex offenders in Orange County are being tracked via satellite using electronic ankle bracelets to determine their proximity to crimes, officials said Friday.While other parolees nationwide are also being tracked using global positioning systems, Orange County’s collaboration between the Sheriff’s Department and the state Department of Corrections and Rehabilitation is the first to automatically cross-reference parolees’ whereabouts with crime locations.
“It’s one of those great tools to potentially identify a suspect, but it also helps us eliminate those people who have not committed the crime,” said Sheriff Michael S. Carona.
Twenty-one high-risk sex offenders in Orange County began being tracked by GPS this week. Officials expect to increase the number to 40 within two weeks.
